Please read these Terms of Service (“Terms”) carefully before using the ANRO Projects platform, mobile applications, or any related services (collectively, the “Service”) operated by ANRO Projects (“ANRO Projects”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance and Eligibility
You must be at least 18 years old and have the legal authority to enter into contracts on behalf of yourself or your organization to use the Service. By accepting these Terms, you represent that you meet these requirements.
2. Description of the Service
ANRO Projects provides construction project management software, including a web-based admin and accountant dashboard and an engineer mobile application. The Service enables organizations to manage contracts, claims, expenses, daily site reports, site orders, and related project data.
3. Accounts and Organizations
Organization accounts. The Service is structured around organization accounts (“tenants”). An administrator creates and manages the organization account and is responsible for inviting users, assigning roles, and maintaining account security.
Your responsibilities. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at info@anroprojects.com if you suspect unauthorized access.
Accurate information. You agree to provide accurate and complete information when creating an account and to keep it updated.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to violate any applicable law or regulation.
- Upload or transmit any content that is unlawful, harmful, defamatory, or infringes third-party rights.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to compete with ANRO Projects or to build a substantially similar product.
- Interfere with or disrupt the integrity or performance of the Service.
5. Your Content
Ownership. You and your organization retain ownership of all data, files, and content you submit to the Service (“Your Content”).
License to us. By submitting Your Content, you grant ANRO Projects a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely to provide the Service to you.
Your responsibility. You are solely responsible for the accuracy, legality, and appropriateness of Your Content. We do not review or verify the content you submit.
6. Intellectual Property
The Service, including its design, software, trademarks, and documentation, is owned by ANRO Projects and protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
7. Payment and Subscriptions
If your use of the Service is subject to subscription fees, pricing and payment terms will be provided separately. We reserve the right to change pricing with advance notice. Failure to pay may result in suspension or termination of your account.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Confidentiality
Each party agrees to keep confidential any non-public information received from the other party that is marked as confidential or that a reasonable person would understand to be confidential, and to use such information only to perform obligations under these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANRO PROJECTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless ANRO Projects and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.
13. Term and Termination
These Terms are effective from the date you first access the Service and continue until terminated. Either party may terminate at any time by providing written notice. We may also suspend or terminate your access immediately if you breach these Terms or if required by law.
Upon termination, your right to use the Service ceases. We will handle Your Content in accordance with our Privacy Policy and any applicable data retention obligations.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Effective date” at the top of this page. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We will provide notice of material changes where required by law.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which ANRO Projects is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
